These Terms & Conditions ("Terms") govern your use of Speak English With Lourdes (the "Service"), operated by Lourdes Lopez ("we", "us", "I"). By creating an account or using the Service, you agree to these Terms.
1. Who you are contracting with
You are entering into these Terms with Lourdes Lopez. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. Individual users must be of legal age in their jurisdiction.
2. The Service
The Service provides English-language learning content, AI-powered conversation practice, e-books, quizzes, progress tracking, and certificates. Features may change or be added over time.
3. Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.
4. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use it for unlawful purposes, fraud, or spam.
- Infringe intellectual property or other rights.
- Interfere with security, probe, scan, scrape, or upload malware.
- Attempt to reverse engineer, resell, or redistribute the Service.
- Circumvent technical limits or usage caps.
5. AI-generated content
The Service includes generative AI features. You are responsible for your prompts, how you use outputs, and for verifying accuracy. AI outputs may be inaccurate and are not a substitute for professional advice. You must not use the Service to produce illegal content, hate speech, harassment, malware, or content that infringes others' rights. We may filter, restrict, or remove content and suspend accounts that violate these rules. Rights holders can report infringement via the contact page; repeated infringement may result in account termination.
6. Intellectual property
The Service and its content (software, lessons, e-books, branding, illustrations) are owned by Lourdes Lopez or her licensors. You get a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You keep the rights to content you submit, and grant us a limited licence to host and process it solely to provide the Service.
7. Pricing
The Service is currently offered free of charge. E-books shown in the library are sold separately on Lourdes' personal website; those purchases are governed by the terms of that website, not by these Terms.
10. Availability and warranties
We work to keep the Service reliable but do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability for any claim relating to the Service is limited to USD $100. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where the law does not allow such exclusion.
12. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the Service and delete your account at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable period unless the law requires otherwise.
13. Changes
We may update these Terms. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction where Lourdes Lopez is established, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory local law provides otherwise.
